Terms and Conditions for the Real Estate Auction

By registering to bid and/or submitting a bid in this auction, you agree to be bound by these terms and conditions. As a registered bidder, you agree to abide by the following terms. You also agree to pay, and authorize the payment of, any applicable fees incurred due to negligence or default.

Minimum Opening Bid

  • Opening bid of $850,000

  • This property is priced to sell

  • NO RESERVE auction

Registration Requirements

  • To participate in the auction, you must complete the Stenella Auction Real Estate registration form prior to placing a bid or offer.

  • By registering, you authorize Stenella Auctions to place an authorization hold of $5,000 on the credit card you have on file. This is a hold only, not a deposit or charge, and will not be applied to the invoice total. Ensure your credit card information is current and that the address on your bidder profile matches the address on your credit card statement.

  • If you are working with a Buyer's Agent, include your agent's name, phone number, and email on the Stenella Antiques Real Estate registration form.

Buyer's Premium, Payment and Settlement

  • Buyer's Premium: A buyer's premium of 10% will be added to the winning bid to determine the Final Purchase Price. For example, a winning bid of $200,000 will result in a Final Purchase Price of $220,000 ($200,000 + $20,000)

  • Bidding Period: Bids over $850,000 will be accepted starting November 1, 2024, until the live auction on December 11, 2024. The highest bid at the live auction will serve as the opening bid. 

  • Pre-Bidding: Pre-bidders may increase their bids during the live auction if a higher bid is placed.

  • Settlement: Settlement will occur within 30-45 days after the auction closes or as agreed upon with the seller.

  • Title: The property will be conveyed with good and marketable title, free of all liens, but subject to existing deed restrictions, historic preservation restrictions, building restrictions, ordinances, easements and rights of public service companies.

  • Due Diligence: All bidders, whether pre-bidding or bidding live, are encouraged to conduct their own inspections and due diligence.

  • Property Condition: The property is being sold AS-IS, without contingencies, (unless agreed upon in writing).

  • Buyer's Agent Commission: A commission of 2.5% will be paid to the Buyer's Agent, who must be listed on the pre-bid form or live registration before submitting a bid.

  • Binding Agreement: The winning bidder enters into a binding agreement to purchase the property at the Final Purchase Price as calculated above.

  • Deposit: The winning bidder must submit a non-refundable deposit of $25,000 on the day of the sale. Additionally, a deposit of 10% of the Final Purchase Price is due within 48 hours of the sale, along with a completed agreement of sale prepared by the seller's agent (Kevin Steiger of Kurfiss Sothebys).

  • Pre-Bid Offers: The seller reserves the right to accept a pre-bid at any time. If an acceptable pre-bid is received, Stenella Auctions will allow previous pre-bidders to submit their best and final offers. This opportunity is exclusive to those who pre-bid.

  • Cancellation of Live Auction: If a pre-bid offer is accepted by the seller and buyer, Stenella Auctions reserves the right to cancel the live auction.

  • Bid Discretion: Stenella Auctions reserves the right to disregard any and all bids.

Real Estate Offered

  • The property is being sold AS-IS, WHERE-IS, with all faults, in its present condition. Stenella Auctions makes no representations or warranties regarding its condition.

  • The property is being sold in partnership with Kevin Steiger of Kurfiss Sotheby's International Realty.

  • Information on the Stenella Auctions website or any other published information is based on the best information available at the time of preparation and is for marketing purposes only. You are required to conduct your own independent investigation.

  • Each potential buyer is responsible for conducting their own independent inspections, investigations, and inquiries concerning the property before submitting a bid.

  • Stenella Auctions and the Seller assume no liability for the accuracy, errors, or omissions of any information regarding the property.

Release and Waiver of Liability

  • By registering to bid, you acknowledge and agree that the auction will take place online only.

  • You understand that Stenella Auctions is not responsible for any technological disruptions, errors, or failures (including difficulties in bidding or the inability to execute, recognize, or record online bids). These disruptions may result from various factors such as loss of connectivity, breakdowns, disruptions, or failures of any online auction platform, your internet connection, computer, or system, or other unforeseen circumstances. While Stenella Auctions may choose to continue, suspend, delay, extend, reschedule, or close the auction due to such disruptions, it is not obligated to do so.
